Entire Agreement
These General Terms and Conditions, together with the information provided during checkout, the order submitted by the customer, and the relevant order confirmations, govern purchases made through the DeviceBazar online store operated by ZLS Services GmbH.
Different or additional terms proposed by a business customer shall apply only if expressly accepted by DeviceBazar.
These Terms do not limit any mandatory statutory rights available to consumers under German or applicable EU law.
Controlling Terms
DeviceBazar serves both consumers and business customers.
Where these Terms distinguish between a Consumer and an Entrepreneur, a Consumer means a natural person entering into a transaction primarily for purposes outside their trade, business, or profession, while an Entrepreneur acts in the course of commercial or professional activity.
Mandatory consumer-protection provisions take precedence over any conflicting provision of these Terms.
Acceptance of Orders
Products displayed on the DeviceBazar website constitute an invitation to place an order and not, by themselves, a binding acceptance of purchase.
After submitting an order, the customer may receive an automated Order Receipt Confirmation. This confirms that the order has been received but does not constitute final acceptance.
The purchase contract is concluded when DeviceBazar sends an Order Shipping Confirmation confirming shipment of the relevant products. This procedure is confirmed in the DeviceBazar brief.
DeviceBazar may reject or cancel an order where, for example:
- customer or order information is incomplete or incorrect;
- an obvious pricing or website error has occurred;
- the ordered product is unavailable;
- payment cannot be processed;
- delivery to the specified destination is not possible;
- there is reasonable suspicion of fraud or misuse.
The brief specifically confirms incomplete or incorrect information, website errors, and lack of stock as grounds for refusing an order.
If payment has already been collected for an order that cannot be fulfilled, the corresponding amount will be refunded.
Prices
All product prices on DeviceBazar are stated in euros (EUR) and include VAT where applicable.
Shipping costs are calculated separately based on the order, delivery destination, and available shipping method. The final amount payable is displayed during checkout before the order is submitted.
For deliveries outside the European Union, customs duties, import taxes, or similar local charges may apply. Such charges are not included in the DeviceBazar shipping price and are payable by the recipient where applicable.

DeviceBazar delivers throughout the European Union, as well as to the United Kingdom, Norway, and Switzerland.
Orders are normally processed within 1–2 business days. Standard delivery within the EU may take up to 6 business days after payment is received. For products marked as pre-order items, delivery may take up to 8 business days.
Delivery dates and times are estimates unless DeviceBazar has expressly agreed to a binding delivery date. Deliveries outside the EU may take longer because of customs clearance, local carrier procedures, or other external circumstances.
DeviceBazar works with delivery services including DHL, Hermes, and FedEx.
After dispatch, the customer receives a tracking number by email.
Transportation and Risk of Loss
The available carrier and shipping methods depend on the delivery destination and order characteristics. Available options are shown during checkout.
For consumer purchases, the risk of accidental loss or damage does not generally pass to the consumer merely because DeviceBazar hands the parcel to its carrier. Under German consumer-sales rules, special protection applies until the goods are delivered to the consumer or a person designated by the consumer, subject to the statutory exceptions.
If a shipment is lost or damaged, the customer should contact DeviceBazar and provide the order number and relevant details. Photographs may be required for damaged products or incorrect deliveries.
Where a claim with the carrier is necessary, DeviceBazar as sender opens the claim. Depending on the circumstances, the solution may include replacement or refund.
Different transport-risk rules may apply to business customers where permitted by law.
Cancellation or Modification
Customers may request cancellation of an order before it has been shipped by contacting DeviceBazar.
Once an order has been shipped, cancellation before dispatch is no longer possible. Consumers may nevertheless have a statutory right of withdrawal for eligible distance purchases.
Under German law, consumers generally have a 14-day right of withdrawal for distance contracts, subject to statutory exceptions.
DeviceBazar does not apply the 25% cancellation fee stated in the supplied reference; this condition is not supported by the DeviceBazar brief.
Any request to modify an order is subject to its current processing status and product availability.
Taxes
Product prices are displayed in euros and include VAT where applicable.
For deliveries within the European Union, applicable taxes are handled according to the relevant tax rules.
For orders delivered to the United Kingdom, Norway, Switzerland, or other applicable non-EU destinations, customs duties, import VAT, or other charges imposed by local authorities may be payable by the recipient and are not included in the delivery charge.
Warranty and Disclaimer
Products sold to consumers are covered by the mandatory statutory rights applicable under German law.
For new products, claims relating to defects are generally subject to a two-year statutory limitation period starting from delivery.
Where a product is defective, consumers may generally request supplementary performance through repair or replacement. Necessary costs associated with statutory supplementary performance, including applicable transport, labour, and material costs, are borne by the seller in accordance with German law.
DeviceBazar's confirmed internal warranty process provides for diagnosis and replacement where a set-top box is confirmed to be non-functional.
MAG manufacturer warranty support is additionally available through warranty@infomir.com or the warranty form on Infomir's website.
Any voluntary manufacturer's warranty exists in addition to, and does not replace, mandatory consumer rights against the seller.
Limitation of Liability
DeviceBazar's liability is governed by applicable German law.
Nothing in these Terms excludes or limits liability where such limitation would be prohibited by mandatory law, in particular in cases involving intent, gross negligence, injury to life, body or health, or mandatory liability under product-liability legislation.
Mandatory consumer warranty and other consumer-protection rights remain unaffected.
The reference provision limiting all Seller liability to the purchase price and requiring every claim to be brought within one year has not been carried over, because such a blanket limitation would not be appropriate for DeviceBazar's B2C terms under German law.
Return of Goods
Consumers purchasing eligible goods online generally have the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason.

For a standard withdrawal, the customer bears the direct cost of return shipping.
Products should be returned complete with their accessories and, where possible, original packaging. The absence of the original packaging alone does not remove a consumer's statutory withdrawal right.
Refunds are made within the applicable statutory period and generally using the same payment method as the original transaction. DeviceBazar may withhold reimbursement until the returned goods have been received or the customer provides evidence that they have been sent back, as permitted by law.
The five-day inspection and irrevocable acceptance rule contained in the reference is not applicable to DeviceBazar consumers.
For commercial transactions between merchants, separate inspection and notification obligations may arise under German commercial law, including §377 HGB.
Indemnity
Customers are responsible for damage caused by unlawful or improper use, handling, storage, or unauthorised modification of products where responsibility arises under applicable law.
Nothing in this provision creates an obligation for consumers to indemnify DeviceBazar beyond what is permitted by applicable law.
The extensive indemnification clause contained in the reference has therefore not been reproduced for consumer transactions.
Payment
DeviceBazar currently accepts:
- bank cards;
- PayPal.
For card payments, the account is normally debited within 72 hours after the order is placed. PayPal payments are processed according to the applicable rules of PayPal.
Products are shipped after the required payment has been received or confirmed.
No separate B2B payment terms, 30-day invoice payment period, or bank-transfer arrangement are currently confirmed in the DeviceBazar brief.
Therefore, the reference provision providing for Net 30 payment and 1.5% monthly interest has not been carried over.
Governing Law and Jurisdiction
These Terms and purchase contracts concluded through DeviceBazar are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer-protection provisions that may apply to consumers in their country of residence.
The DeviceBazar brief identifies German law as the reference position but states that the final jurisdiction wording should be confirmed by legal counsel.
For this reason, the new AGB should not state an unverified exclusive court jurisdiction for all customers.
For business customers, a specific place-of-jurisdiction clause may be included where legally permitted once the company's preferred jurisdiction has been confirmed.
