1. SCOPE OF APPLICATION
These Terms and Conditions of ZLS Services GmbH, operating the DeviceBazar online store (hereinafter referred to as “DeviceBazar”, “we”, “our”, or “us”), apply to contracts concluded through the DeviceBazar website between ZLS Services GmbH and its customers.
DeviceBazar serves both:
- Consumers — natural persons acting primarily for purposes outside their trade, business, or profession; and
- Entrepreneurs / business customers — natural or legal persons acting in the course of their commercial or professional activity.
Where different statutory rules apply to consumers and business customers, this is stated separately.

2. ORDERS AND CONTRACT CONCLUSION
2.1. Placing an Order
The presentation of products on the DeviceBazar website does not by itself constitute a binding contractual offer. Customers select the required products, add them to the shopping cart, provide the information required for billing and delivery, select an available payment and shipping method, and submit the order through checkout.
Before submitting the order, the customer has the opportunity to review the order information and correct any errors.
By placing an order, the customer confirms that they are legally capable of entering into the relevant purchase contract.
2.2. Order Receipt Confirmation
After an order is placed, DeviceBazar may send an automated confirmation showing that the order has been received.
The Order Receipt Confirmation may include information such as:
- products ordered;
- prices;
- delivery address;
- shipping costs;
- selected payment method.
The automated Order Receipt Confirmation does not itself constitute acceptance of the order.
2.3. Order Shipping Confirmation
An order is accepted and the purchase contract is concluded when DeviceBazar sends the Order Shipping Confirmation confirming that the relevant products have been shipped.
This order-acceptance procedure is confirmed for DeviceBazar in the current company brief.
Products are dispatched after the required payment has been successfully processed or confirmed.
If you do not receive an expected order confirmation, please check your spam or junk folder or contact DeviceBazar.
3. WHEN ORDERS MAY NOT BE ACCEPTED
DeviceBazar may be unable to accept or fulfil an order in certain circumstances, including where:
a) incomplete, incorrect, or potentially fraudulent customer or payment information has been provided;
b) an error concerning a product, price, or other information has occurred on the website;
c) the ordered product is no longer available;
d) payment cannot be successfully processed;
e) delivery to the specified address is not possible;
f) there are reasonable grounds to suspect fraud, abuse, or unlawful activity.
The DeviceBazar brief specifically confirms incorrect/incomplete information, website errors, and unavailable stock as possible reasons for refusing or cancelling an order.
If DeviceBazar cannot fulfil an order for which payment has already been collected, the corresponding amount will be refunded.
Customers may also request cancellation before the order has been shipped by contacting DeviceBazar. Whether cancellation is still possible depends on the processing status of the order.
4. ABOUT PRODUCT DETAILS
4.1. Product Information
DeviceBazar makes reasonable efforts to keep product descriptions, specifications, images, availability information, and prices accurate and up to date.
Minor differences may occur between images displayed on a screen and the physical appearance of a product, including differences caused by display settings.
DeviceBazar is an official MAG dealer and sells original MAG products supplied through official channels.
4.2. Changes to Product Information
DeviceBazar may update product information, prices, descriptions, technical specifications, and availability displayed on the website.
Changes made after an order has been accepted do not retroactively alter the terms applicable to that accepted order.
5. TERMS OF PAYMENT
5.1. Prices and Currency
Prices on DeviceBazar are stated in euros (EUR) and include VAT where applicable.
The price applicable to an order is the price displayed during checkout when the order is submitted, subject to correction where an obvious error has occurred and the order has not yet been accepted.
5.2. Shipping Costs
Shipping charges are additional unless free delivery applies to the particular order or promotional offer.
The shipping cost is calculated automatically according to factors including:
- destination;
- order contents;
- parcel size or weight;
- available delivery method.
The final applicable shipping price is displayed during checkout.
5.3. Payment Methods
DeviceBazar currently accepts:
- bank card payments;
- PayPal.
The payment methods actually available for a particular order are displayed at checkout.
5.4. Payment Processing
For bank card payments, the amount is normally debited within 72 hours after the order is placed.
PayPal transactions are processed in accordance with the applicable terms and procedures of PayPal.
Customers should complete payments only through the payment options provided in the official DeviceBazar checkout.
5.5. Business Customers
No separate B2B bank-transfer procedure or special B2B payment rules are currently confirmed for DeviceBazar.
6. SHIPPING AND DELIVERY CONDITIONS
6.1. Dispatch Location

6.2. Delivery Countries
DeviceBazar delivers throughout the European Union and also to:
- the United Kingdom;
- Norway;
- Switzerland.
6.3. Order Processing
Standard orders are normally processed and prepared for shipment within 1–2 business days.
6.4. Delivery Time
Standard delivery within the EU may take up to 6 business days after payment is received.
For products identified as pre-order items, the delivery period may be extended to up to 8 business days.
These periods are estimates unless a specific binding delivery date has expressly been agreed.
Delivery outside the EU may take longer because of customs clearance, local carrier procedures, or other circumstances outside DeviceBazar's reasonable control.
6.5. Delivery Partners
Depending on the destination and available shipping options, DeviceBazar works with carriers including:
- DHL;
- Hermes;
- FedEx.
Available carriers and shipping options may vary depending on the order and destination.
6.6. Tracking
After the order has been dispatched, the customer receives a tracking number by email.
In some countries, an international carrier may hand the parcel over to a local delivery provider for final delivery.
6.7. Delivery Outside the EU and Customs
For shipments to the United Kingdom, Norway, Switzerland, and other applicable non-EU destinations, customs clearance may be required.
Customs duties, import taxes, and similar charges are not included in the DeviceBazar shipping price and are payable by the recipient where applicable.
6.8. Lost or Damaged Shipments
If a shipment appears to be lost, DeviceBazar can investigate the case using the carrier's tracking information.
Where a carrier claim is required, DeviceBazar as the sender initiates the claim.
If a parcel or product arrives damaged, the customer should contact DeviceBazar and provide:
- the order number;
- a description of the problem;
- photographs of the damage where applicable.
For incorrect products, photographs may also be requested.
Depending on the circumstances, the matter may be resolved through replacement or refund where applicable.
For consumer purchases, mandatory statutory rules concerning delivery risk remain unaffected.
7. RETURN POLICY
7.1. Return Policy for Consumers
7.1.1. Right of Withdrawal
Consumers purchasing goods online generally have a statutory right to withdraw from the contract within 14 days without giving a reason.
7.1.2. Withdrawal Period
For goods, the 14-day withdrawal period generally begins when the consumer, or a third party nominated by the consumer other than the carrier, receives the goods.
7.1.3. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, the consumer must send DeviceBazar a clear statement communicating the decision to withdraw.

7.1.4. Returning the Product
After notifying DeviceBazar of the withdrawal, the goods should be returned to:

7.1.5. Exceptions
The statutory withdrawal right is subject to the exceptions provided by German law. Depending on the particular goods, these may include, for example, products made to the consumer's specifications and certain sealed goods where the statutory conditions for exclusion are met.
No additional DeviceBazar-specific exclusions have been confirmed in the current brief.
7.1.6. Condition of Returned Goods
Products should be returned complete with the accessories supplied with them and, where possible, in their original packaging.
The customer should use suitable packaging to protect the product against damage during return transport.
DeviceBazar's preferred return condition is complete contents with packaging.
7.1.7. Original Packaging
The absence of the original packaging alone does not remove a consumer's statutory right of withdrawal.
The consumer may, however, be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods, where the statutory requirements for such liability are met.
7.1.8. Consequences of Withdrawal
DeviceBazar will refund payments due following a valid withdrawal within 14 days after being informed of the consumer's decision to withdraw.
The refund may be withheld until DeviceBazar receives the returned goods or the consumer provides evidence that they have sent the goods back, whichever occurs first.
The refund is made using the same payment method used for the original transaction, unless another method has expressly been agreed.
For a standard withdrawal, the customer bears the direct cost of returning the product.
7.2. Damaged, Incorrect, or Defective Products
A return because of a defect or incorrect delivery is different from a standard change-of-mind withdrawal.
If an item is damaged or the wrong product has been delivered, please contact DeviceBazar with the order number and, where applicable, photographs showing the issue.
For a valid consumer claim concerning non-conforming goods, the statutory rights described in Section 9 apply.
7.3. Business Customers
The statutory 14-day consumer withdrawal right does not automatically apply to purchases made by entrepreneurs acting in the course of their business.
No separate voluntary DeviceBazar B2B return policy is confirmed in the current brief.
8. LIABILITY
DeviceBazar is liable in accordance with applicable law.
Nothing in these Terms excludes or restricts liability where such exclusion or restriction would be prohibited by mandatory law, including liability arising from intent, gross negligence, injury to life, body, or health, or mandatory product-liability provisions.
Any limitations applicable to business customers are subject to mandatory German law and do not restrict mandatory statutory rights of consumers.
9. WARRANTY
9.1. Statutory Warranty Rights
Warranty rights for consumers are governed by the applicable statutory provisions.
Under German and EU consumer law, the seller is responsible where goods do not conform to the contract. Consumers have a minimum 2-year legal guarantee for goods purchased in the EU.
These statutory rights are separate from any voluntary commercial or manufacturer warranty.
9.2. Warranty Period
For new goods purchased by consumers, claims for defects are generally subject to a 2-year limitation period beginning when the product is delivered.
This replaces the wording in the old reference stating that the period begins when the product is first commissioned or used.
If a lack of conformity becomes apparent within one year after delivery, German consumer law generally presumes that the defect already existed when the goods were transferred to the consumer, unless this presumption is incompatible with the nature of the goods or defect.
9.3. Reporting a Defect
Customers should report a suspected defect as soon as reasonably possible and provide sufficient information for the case to be assessed.

The current DeviceBazar brief confirms the name, address, problem description, and device serial number as information used for warranty processing.
9.4. Diagnosis, Repair, and Replacement
If a product is defective, the consumer is generally entitled to have the goods brought into conformity through repair or replacement.
The customer may in principle choose between these remedies, subject to the statutory rules allowing the seller to refuse a particular method where it would be impossible or would involve disproportionate costs.
DeviceBazar's confirmed internal procedure currently provides for diagnosis and replacement if a set-top box is confirmed to be non-functional.
This internal procedure does not restrict the consumer's mandatory statutory rights.
9.5. Price Reduction or Refund
Repair or replacement are normally the primary remedies.
Depending on the circumstances specified by law, consumers may subsequently have the right to reduce the purchase price or withdraw from the contract, resulting in a refund. This can apply, for example, where proper supplementary performance has failed, has been refused, or has not been completed as required by law.
A refund is therefore not automatically the first remedy for every product defect.
9.6. Costs of Returning a Defective Product
For a valid statutory consumer claim, the seller bears the necessary costs of supplementary performance, including applicable transport, labour, and material costs.
Customers should contact DeviceBazar before sending a defective device so that the appropriate return or diagnostic procedure can be provided.
The current DeviceBazar service-centre procedure separately states that the customer pays for sending the product to the service centre and the return shipment is covered by the service side.
That rule may apply to the separate manufacturer/service procedure, but does not override a consumer's statutory rights against DeviceBazar as the seller.
9.7. Warranty Processing Time
DeviceBazar will assess the information provided and arrange further diagnosis where required.
No fixed number of days for warranty assessment or repair has been confirmed in the DeviceBazar brief.
German consumer law requires repair or replacement to be carried out within a reasonable period after the seller has been informed of the lack of conformity and without significant inconvenience to the consumer.
For this reason, DeviceBazar does not state an unconfirmed fixed processing period such as 7, 10, or 14 business days.
The customer will be informed about the next steps after the initial assessment.
9.8. Damage Not Caused by a Product Defect
Statutory defect rights do not automatically cover problems caused solely after delivery by circumstances attributable to the customer, such as:
- accidental damage;
- improper use;
- use contrary to product instructions;
- unauthorised modifications;
- external damage unrelated to a lack of conformity existing at delivery.
Each claim is assessed individually.
9.9. Manufacturer Warranty
Any voluntary manufacturer's commercial warranty is additional to statutory consumer rights and cannot replace or reduce the legal guarantee provided by the seller.

9.10. Business Customers
Different statutory rules may apply to entrepreneurs.
The current DeviceBazar brief does not confirm a separate contractual warranty period for B2B purchases. Therefore, I would not carry over the old reference's one-year B2B warranty limitation into the new page without separate legal confirmation.
10. FORCE MAJEURE
DeviceBazar is not responsible for delays or failures to perform contractual obligations to the extent that they result from circumstances outside its reasonable control.
Such circumstances may include, depending on the individual case:
- natural disasters;
- war or civil unrest;
- government restrictions;
- strikes affecting third-party infrastructure;
- major transport disruptions;
- interruption of communications or logistics networks;
- other comparable events outside DeviceBazar's reasonable control.
Where such circumstances affect performance, DeviceBazar will take reasonable steps to minimise their impact and resume performance when reasonably possible.
Mandatory consumer rights remain unaffected.
11. PRIVACY
Personal data is processed in accordance with the DeviceBazar Privacy Policy and Cookie Policy.
Detailed privacy and cookie provisions are not repeated on this page and should be governed by the dedicated policies of the website.
12. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions is not affected.
Where required, the invalid provision will be replaced by the applicable statutory rule.
13. APPLICABLE LAW AND JURISDICTION
13.1. Applicable Law
These contractual relations are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protection provisions that may apply to consumers in their country of residence.
13.2. Consumers
Nothing in these Terms deprives consumers of mandatory protections available to them under applicable consumer law.
13.3. Business Customers
Rules concerning jurisdiction for entrepreneurs may differ from those applicable to consumers and are governed by applicable German and EU law.
Because the current DeviceBazar brief marks the jurisdiction clause as requiring legal confirmation, I would not retain the old reference's categorical “exclusive jurisdiction” or Offenbach am Main place-of-performance clause without review by the company's lawyer.
14. AMENDMENTS
DeviceBazar may update these Terms from time to time, for example to reflect changes to business processes, services, or applicable law.
The version applicable to an order is generally the version in effect when the relevant contract is concluded.
Changes to these Terms do not retroactively remove statutory rights or alter an already concluded purchase contract unless permitted by law and expressly agreed where required.
